KATA Friends Mini Energy Feature User Agreement

This agreement constitutes a legally binding contract between the provider and operator of SwitchBot products and services (hereinafter referred to as “SwitchBot” or “we,” including SWITCHBOT Co., Ltd., Wonderlabs Inc., and their respective parent companies, subsidiaries, and affiliates) and all entities (including, but not limited to, individuals and teams; hereinafter referred to as “Users”) using the KATA Friends Mini Energy Feature, with respect to the use of this feature and related services.

This agreement applies to the KATA Friends Mini Energy Feature (hereinafter referred to as “this Feature”), including any upgrades and updates to the services and software used by Users during the term of this agreement. By using this Feature, Users acknowledge that they have read, understood, and agreed to all the terms of this agreement.

SwitchBot fully respects and is committed to protecting Users’ personal information. Please read the “KATA Friends Mini Energy Feature Privacy Policy” to understand the policies and procedures applicable to the collection and use of Users’ personal information in connection with this Feature.

1. Scope

1.1 These terms apply to subscription plans and free trials for value-added services that you purchase, use, or manage via the SwitchBot App or through app stores such as the Apple App Store or Google Play.

1.2 Subscription services are linked to your SwitchBot account. Upon a successful subscription, the associated benefits are granted to the account used at the time of purchase. Unless otherwise required by law or the rules of the respective app store, subscription benefits may not be transferred, rented, sold, exchanged for cash, or moved to another account.

2. Subscription Plans and Key Benefits

2.1 Non-subscribed Status: Once a User links a KATA Friends Mini device within the SwitchBot App, the account is set to a non-subscribed status by default, during which the cloud-based “Energy” conversation feature is unavailable.

2.2 Basic Plan: Currently offered as a monthly subscription, this plan provides a daily allowance of 20 minutes of conversation time per device. This allowance cannot be shared across multiple devices. The cost of the plan is determined by the number of supported devices. Please refer to the subscription confirmation page for specific feature benefits and usage rules.

2.3 Premium Plan: Currently offered as a monthly subscription, this plan provides a daily allowance of 60 minutes of conversation time per device. This allowance cannot be shared across devices. The plan price is determined by the number of supported devices. Specific features, benefits, and usage rules are as detailed on the subscription confirmation page.

2.4 The specific name, price, subscription cycle, applicable region, features, benefits, eligibility for discounts, and any restrictions for each plan are governed by the information displayed on the SwitchBot App subscription page and the app store’s payment confirmation page. In the event of any discrepancy between the information on these two pages, the plan details, amount, and billing cycle displayed on the app store at the time of final payment confirmation shall prevail.

2.5 Product Scope: 4G-enabled devices and Wi-Fi-only devices cannot share the same subscription plan; they must be subscribed to separately.

3. Subscription Pricing and Payment

3.1 Subscriptions must be completed via the payment interface for the Apple App Store or Google Play, as accessed through the SwitchBot App. The currency, price (including taxes), discounted rates, and settlement methods are determined by the respective app store based on your region, account settings, and applicable policies.

3.2 By confirming your subscription, you authorize the respective app store to charge your linked payment method according to the amount and billing cycle shown on the payment confirmation page. We do not directly access or store your full bank card details, payment account passwords, or other sensitive payment credentials.

3.3 The current Basic and Premium plans are billed and renewed on a monthly basis. Should other subscription cycles be introduced in the future, the specific terms regarding the cycle, billing, and renewal will be as stated on the SwitchBot App subscription page and the app store’s payment confirmation page at the time of purchase.

4. Allocation, Reset, and Deduction of “Energy Points”

4.1 “Energy Points” represent the daily usage allowance for AI-powered cloud conversations with KATA Friends Mini. Once the subscription service is active, each device linked to the plan receives 100 Energy Points per day. For plans covering multiple devices, Energy Points are calculated individually for each device and cannot be shared or accumulated across devices. The Basic Plan provides 20 minutes of daily cloud-based AI conversation per device, while the Premium Plan provides 60 minutes of daily cloud-based AI conversation per device.

4.2 The “Energy Points” for each device are reset to 100 at 04:00 daily. Unused Energy Points do not carry over to the next day and cannot be exchanged for cash. The daily reset of Energy Points is calculated independently of your subscription and billing cycle.

4.3 When a cloud-based AI conversation is initiated via voice wake-up on the device, Energy Points are deducted based on the duration of the conversation. The Basic Plan consumes 5 Energy Points per minute, while the Premium Plan consumes approximately 1.67 Energy Points per minute. For multi-device plans, each device consumes its own daily Energy Points and conversation allowance independently. Please refer to the SwitchBot App for your current remaining balance.

4.4 Local responses triggered by physical touch, touch sensors, or accelerometers—as well as on-device animations—do not utilize cloud-based AI; therefore, they do not consume Energy Points and remain unaffected if the daily cloud conversation allowance is exhausted. Diary entries generated automatically via background processes do not consume Energy Points.

4.5 Once a device’s daily Energy Points are exhausted, it can no longer engage in cloud-based AI conversations for the remainder of the day, and the device will provide a notification to this effect. Local interactions, however, will continue to function normally. After the daily reset at 04:00, you may resume cloud-based AI conversations according to the terms of your active plan. If you upgrade to a plan with a higher daily conversation allowance, the available duration for that device will increase in accordance with the new plan’s rules. Note that the daily maximum for Energy Points remains 100. Specific effective dates and entitlements will be as displayed in the App Store or the SwitchBot App.

5. Free Trials and Promotional Offers

5.1 We may offer free trials, discounted pricing, or other subscription incentives to eligible users via the App Store or Google Play. Details regarding eligible users, applicable subscription plans, trial durations, trial allowances, campaign periods, and participation requirements are as displayed on the subscription page, campaign page, or the payment confirmation page within the app store.

5.2 Users must complete the subscription process as instructed within the app store. During the free trial period, the subscription price is typically displayed as 0; if a different promotional price is shown, the information provided on the app store’s payment confirmation page shall prevail.

5.3 The free trial is an auto-renewing subscription. Unless you cancel the auto-renewal through the original purchase channel before the free trial period expires and the renewal charge occurs, the app store will automatically renew your subscription and process a payment based on the full renewal price and billing cycle applicable to your chosen plan at that time.

5.4 Eligibility for a free trial is determined by the respective app store based on your account, subscription history, subscription group, and campaign rules. The presence of a “free trial” indicator on a page does not guarantee that every user is eligible; final eligibility, the duration of the trial, and details regarding the initial charge are as shown on the app store’s payment confirmation page.

6. Auto-Renewal

6.1 Both the Basic and Premium plans are auto-renewing subscriptions. Currently, these plans operate on a monthly billing cycle; should other billing cycles become available, the terms displayed on the app store’s payment confirmation page at the time of your subscription shall apply. Your subscription will continue until you cancel it, or until it is terminated due to reasons such as a failed payment, a refund, an account issue, or actions taken by the app store.

6.2 At the end of each subscription cycle, the App Store or Google Play will charge your authorized payment method for the next cycle—based on the renewal price applicable to your chosen plan at that time—and extend the validity period of your subscription accordingly.

6.3 Specific renewal amounts, charge dates, and the date of the next renewal are as shown on the app store’s payment confirmation page, order details, or subscription management page. Please monitor any notifications sent by the app store regarding your subscription, charges, or changes to pricing.

7. Canceling Auto-Renewal and Subscription Expiration

7.1 You may cancel auto-renewal via the subscription management feature of the original purchase channel before the next scheduled renewal charge:

  • App Store: Cancel via the “Subscriptions” management page for your Apple ID.
  • Google Play: Cancel via the “Payments & subscriptions” / “Subscriptions” management page in Google Play.

7.2 Canceling auto-renewal does not immediately terminate your current, paid-for subscription service. You may continue to access the benefits of your plan until the end of the current subscription period. Once this period expires, the app store will no longer charge you for the subsequent cycle, and your paid subscription benefits will cease.

7.3 If you cancel auto-renewal during a free trial, you may continue to use the trial benefits until the trial period ends; no further charges will be incurred thereafter. If a charge for the next cycle has already been processed by the app store, the cancellation will generally take effect starting from the following subscription cycle, while the service for the current, already-paid cycle will remain active.

7.4 Upon the expiration of a paid plan, if your account remains linked to a KATA Friends Mini device, the device’s paid cloud-based AI conversation features will be terminated. Local device functions that do not rely on a subscription—such as responses to physical touch or on-device animations—will remain available.

8. Plan Upgrades, Downgrades, and Cycle Changes

8.1 Subject to the capabilities of the App and the respective app store, you may upgrade or downgrade your subscription plan. Specific details—including the scope of changes, pricing, billing amounts, effective dates, the value of any remaining subscription, and the next renewal date—will be as presented in the confirmation information displayed by the app store at the time you modify your plan.

8.2 For subscriptions via the App Store: When upgrading to a higher-tier plan, the new plan typically takes effect immediately. The App Store will charge you for the new plan and, in accordance with Apple’s policies, will calculate and process a pro-rated adjustment for the unused portion of your previous plan. When downgrading to a lower-tier plan, your current plan remains valid for the remainder of the already-paid period; the downgraded plan will take effect starting from the next renewal cycle, with subsequent charges based on the pricing applicable at that time.

8.3 Subscriptions via Google Play: When you upgrade or downgrade your subscription plan—following the current plan-change procedures for this service—the new plan takes effect immediately, and Google Play will charge the associated fees right away. The remaining value of any unused portion of your previous plan will be converted into an equivalent subscription duration for the new plan, in accordance with Google Play’s rules; this may also result in an adjustment to your next renewal date. The actual amount charged, the conversion result, and the next renewal date will be as displayed on the Google Play payment confirmation page and your subscription management page.

8.4 Changes between subscription cycles for a plan of the same tier may take effect either immediately or at the start of the next renewal cycle, depending on the original and new subscription cycles as well as the app store’s rules. Please refer to the information displayed by the app store at the time you confirm the change.

8.5 Once a plan change takes effect, the daily cloud-based AI conversation duration and the rate at which “energy points” are consumed on your linked device(s) will be calculated according to the rules of the new plan. If you upgrade to a plan with a higher daily conversation limit, your available cloud-based AI conversation duration for the current day will increase in accordance with the new plan’s terms. Until a plan change takes effect, services will continue to be provided based on the rules of your previous plan. Conversation duration already used, energy points already consumed, and benefits already enjoyed cannot be converted into cash, unless otherwise required by applicable law or the app store’s rules.

9. Refunds, Transaction Cancellations, and Payment Issues

9.1 In principle, subscription fees that have been paid and for which the subscription has become effective are non-refundable, except where otherwise provided by applicable laws and regulations, mandatory consumer protection provisions in your country or region, or the app store’s rules. This clause does not affect any rights you may have under the law, such as the right to cancel a transaction, obtain a refund, or terminate a service. Eligibility for refunds, application deadlines, the review process, and the issuance of refunds are all handled by the original purchase channel in accordance with its own policies.

9.2 For subscriptions purchased via the App Store, refund requests must be submitted directly to Apple. For subscriptions purchased via Google Play, requests must be made through the refund channels supported by Google Play. Such requests are reviewed and processed by the respective platform according to its own refund policy; the final outcome will be as communicated by that platform.

9.3 In the event of a refund, transaction reversal, chargeback, or payment anomaly, we may—depending on the order status, app store policies, and applicable legal requirements—suspend, adjust, or revoke the paid cloud-based AI chat entitlements associated with your Basic or Premium plan. Any usage that has already occurred and the processing of related refunds shall be governed by the rules of the original purchase channel and applicable laws.

9.4 If a subscription fails to renew due to an invalid payment method, insufficient funds, or a failed charge attempt by the app store, the subscription may enter a grace period, be suspended, or be terminated, subject to the specific handling procedures of the app store.

10. Changes to Services and Terms

10.1 We may adjust plan names, pricing, features, usage quotas, or these Terms based on factors such as product operations, costs, technical capabilities, app store policies, or changes in laws and regulations. In the event of significant changes affecting existing subscribers, we will provide notification—in accordance with applicable laws and app store policies—via the app interface, system notifications, email, or other reasonable means.

10.2 Should the renewal price of a plan change, the requirements for your consent and the effective date of such changes shall be governed by applicable laws and the relevant app store’s policies. If you do not agree to the adjustments, you may cancel your automatic renewal prior to the next scheduled billing date.

11. Miscellaneous

11.1 In the event of any inconsistency between these Terms and the “SwitchBot App User Agreement,” these Terms shall prevail regarding matters of subscriptions, billing, free trials, usage quotas, and plan adjustments; for all other matters, the “SwitchBot App User Agreement” shall continue to apply.

11.2 If any provision of these Terms is found to be invalid or unenforceable, the validity of the remaining provisions shall not be affected.

11.3 If the mandatory laws of your country or region—such as those concerning consumer protection, e-commerce, automatic renewals, refunds, or transaction cancellations—provide you with a higher level of protection, these Terms shall not exclude, limit, or diminish such statutory rights. In the event of any conflict between these Terms and such mandatory legal provisions, the latter shall prevail.

11.4 If you have any questions regarding subscriptions, charges, quotas, or changes to your plan, please contact us via the customer support portal within the app or at https://support.switch-bot.com/.
